So too can Erb’s Palsy be the result of medical malpractice. A delivering obstetrician is required under the standard of care to utilize only gentle traction at all times during the delivery. Too much traction and force applied to the baby’s head and neck during a delivery can result in an abnormal stretching of the infant’s brachial plexus nerves, causing a permanent Erb’s Palsy.
We obtained a $6.5 million dollar settlement on behalf of a child with cerebral palsy caused by medical malpractice. We have also obtained a $ 1.0 million dollar settlement for a child who sustained a permanent Erb’s Palsy injury.
